Terms of Service
Last updated: August 19, 2026
Zuma Volley LLC is a private volleyball coaching business in Salem, Utah, run by Josh McKell. These terms cover coaching sessions, online programs, the athlete portal, and zumavolley.com. Booking a session or using the portal means you agree to them.
Contents
1. Who agrees to this
Most of our athletes are under 18. If your athlete is a minor, a parent or legal guardian must book sessions, sign the athlete agreement and waiver, handle payment, and agree to these terms on the athlete's behalf. By doing any of those things you confirm you have the authority to do so.
A signed athlete agreement and waiver is required before any athlete trains with us. No exceptions.
2. What we offer
- Private lessons — one on one coaching, $65 per hour.
- Small group sessions — 2 to 4 athletes, $45 per player per hour.
- Online coaching programs — training and nutrition programming delivered through the athlete portal, with check-in calls depending on the tier.
Current pricing is on the website. We will always tell you before a price changes, and a change never applies to sessions you have already paid for.
Coaching is a service, not a result. We will work hard for your athlete, but we do not promise playing time, a roster spot, a college offer, a scholarship, or any specific improvement.
3. Booking, cancellation, and no-shows
Sessions are booked through the scheduling link or by arranging a time directly with Josh. A session is confirmed once you have a confirmation from us.
- Cancelling or rescheduling. Give us at least 24 hours notice and we will reschedule at no charge.
- Late cancellations and no-shows. Under 24 hours notice, or not showing up, may be charged as a full session. Life happens, so talk to us, but the reserved time is time we held for you.
- If we cancel. If Josh cancels for any reason, including illness, weather, or a facility problem, you get a reschedule or a full refund of that session, your choice.
- Late arrivals. A session ends at its scheduled end time. If you arrive late, we coach the time that is left.
- Facility closures. If a gym closes unexpectedly, we will reschedule as soon as we can find court time.
For small group sessions, per-player pricing assumes the group shows up. If athletes drop out and the group falls below two, we will talk about converting it to a private lesson at the private rate or rescheduling.
4. Payment
We take payment by card through Stripe, or by Venmo at @ZumaVolley. Payment is due at or before the session unless you are on a monthly program.
- Monthly and ongoing programs bill on a recurring basis until you tell us to stop. Give us notice before your next billing date and you will not be charged again.
- Refunds are handled case by case and in good faith. Unused prepaid sessions can be refunded or credited. Sessions already delivered are not refundable.
- Venmo payments are governed by Venmo's terms. We cannot reverse a Venmo payment through Venmo, so if a refund is due we will send it back to you directly.
- Card details go to Stripe. We never see or store them.
5. Online coaching and the athlete portal
Online clients get access to a portal with their training program, workouts, nutrition plan, session debriefs, and progress tracking.
- Portal access is for your athlete and family. Do not share your login, and do not redistribute the programs, workouts, or nutrition plans in it. They are ours, built for your athlete.
- Access continues while your program is active. If you stop, we will give you a reasonable window to save anything you want to keep before access ends.
- The portal uses an AI assistant to help draft and organize plans. A human coach reviews everything before it reaches you. See the Privacy Policy for what that means for your athlete's information, including how to opt out.
- Check-in call frequency and length depend on your tier and are described when you sign up.
6. Safety, health, and assumption of risk
Volleyball carries real risk of injury. Jumping, diving, and repeated overhead motion can cause sprains, strains, fractures, concussions, and other injuries. By training with Zuma Volley you accept that risk. This is covered in more detail in the athlete agreement and waiver you sign, which controls if anything here conflicts with it.
We are not medical professionals. Josh is a volleyball coach, not a doctor, physical therapist, athletic trainer, or registered dietitian. Nothing we provide, including training programs and nutrition plans, is medical advice, diagnosis, or treatment. Talk to a qualified professional before starting any training or nutrition program, especially if your athlete has an existing condition or injury.
You agree to tell us about any injury, medical condition, allergy, or limitation that could affect your athlete's safety in training, and to keep us updated if it changes. If an athlete is hurt or unwell, keep them home. We would rather lose a session than make something worse.
Nutrition guidance we provide is general performance and fueling guidance for athletes. It is not a treatment plan, and it is not appropriate for anyone managing a medical condition or an eating disorder. If that applies, please work with a physician or a registered dietitian, and we are glad to coordinate with them.
A parent or guardian should be reachable during any session with a minor.
7. Conduct
We expect athletes to show up ready to work, treat teammates and facilities with respect, and follow the rules of whatever gym we are in. We expect the same from parents on the sideline.
We may end a session or stop working with a family, without refund of a session already underway, in the case of abusive behavior toward Josh or another athlete, or conduct that puts someone at risk. This is rare and we would always try to talk it through first.
8. Training materials and media
The programs, drills, workouts, nutrition plans, session debriefs, and written material we create stay ours. You get to use them for your athlete's own training. Please do not sell them, publish them, or hand them to another coach or club.
We may record training clips for coaching review. Posting anything publicly, on Instagram or the website, only happens with a parent or guardian's permission, asked for separately. You can say no, or change your mind later, and it has no effect on coaching.
9. Disclaimers and limits
Coaching services and the portal are provided as is. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose.
To the fullest extent the law allows, Zuma Volley LLC is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or $100. Nothing in these terms limits liability that cannot be limited under Utah law, and the signed waiver governs injury claims.
We are not responsible for facilities we rent, for other athletes' conduct, or for the acts of third parties like Stripe, Venmo, or Google.
10. Changes, law, and contact
We may update these terms. When something material changes, we will update the date above and tell current clients directly. Continuing to book sessions after a change means you accept the updated terms.
These terms are governed by the laws of the State of Utah. Any dispute will be brought in the state or federal courts located in Utah County, Utah. If any part of these terms is unenforceable, the rest stays in effect.
If anything here does not sit right with you, tell us. We would rather talk it through than have you sign something you are unsure about.
